MyHuis Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the services provided by MyHuis, LLC, a Texas limited liability company (“MyHuis,” “we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms.
1. About MyHuis and the Service
MyHuis provides digital tools and services designed to help users manage, coordinate, and track home-related activities, which may include scheduling, maintenance tracking, reminders, communications, recordkeeping, and related support services (the “Service”).
In some cases where MyHuis determines that a requested scope of work requires trade skill or specific licensure, MyHuis may facilitate introductions to third-party service providers and may process payments on behalf of those providers. MyHuis may perform home services where applicable, but does not guarantee the quality, pricing, timing, or completion of services performed by third-party service providers.
Where MyHuis performs home services directly, such services are governed by these Terms and any applicable service-specific disclosures provided at the time of booking.
Claims arising solely from the acts or omissions of third-party service providers must be pursued directly against the applicable provider and not against MyHuis, except to the extent required by applicable law.
2. Eligibility and Account Responsibilities
You must be at least 18 years old and capable of forming a legally binding contract to use the Service.
By using the Service, you represent and warrant that:
You will comply with all applicable federal, state, and local laws and regulations;
All information you provide is accurate, current, and complete;
If you use the Service on behalf of an entity, you have the authority to bind that entity to these Terms.
You are responsible for all activity conducted through your account and for maintaining the confidentiality of your account credentials.
3. Payments, Fees, and Funds Flow
Payment Processing
MyHuis may facilitate and process payments in connection with the Service, including collecting fees and transmitting payments on behalf of users and, where applicable, third-party service providers. Payment processing services are provided through one or more third-party payment processors, and use of such services is subject to the applicable processor’s terms and conditions.
Authorization
By using the Service, you authorize MyHuis to charge applicable fees, process payments, and, where relevant, disburse funds to third-party service providers in accordance with these Terms.
Payment Disputes and Holds
Any disputes regarding payments, fees, or refunds must be raised directly with MyHuis. MyHuis may temporarily withhold, delay, or reverse payments where reasonably necessary to address disputes, suspected fraud, chargebacks, or legal or regulatory compliance.
Disputes relating solely to the performance of third-party services remain between the user and the applicable third-party provider.
Changes to Payment Role
MyHuis may modify its role in payment processing, including how payments are collected or disbursed, upon reasonable notice provided through the Service or by other lawful means.
4. Intellectual Property
All content, software, trademarks, and materials provided through the Service are owned by or licensed to MyHuis and are protected by applicable intellectual property laws. No rights are granted to you except as expressly stated in these Terms.
5. Prohibited Conduct
You agree not to:
Use the Service in violation of any applicable law or regulation;
Misrepresent your identity, authority, or intent;
Circumvent payment obligations, fees, or security features;
Use the Service for fraudulent, deceptive, or harmful purposes.
MyHuis may suspend or terminate access for violations of this section.
6. Modifications to the Terms
MyHuis may modify these Terms from time to time. Material changes will become effective no earlier than thirty (30) days after notice is provided by posting updated Terms on the Service or through other reasonable notice mechanisms.
Material changes will not apply retroactively to disputes arising prior to the effective date of the changes. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
7. Disclaimer of Warranties
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, except as required by applicable law.
8. Limitation of Liability
To the maximum extent permitted by law, MyHuis’s total aggregate liability arising out of or relating to the Service shall not exceed the greater of $7,500 or the amounts paid by you to MyHuis in the six (6) months preceding the event giving rise to the claim.
Nothing in these Terms limits liability that cannot be limited under applicable law.
9. Indemnification
You agree to indemnify, defend, and hold harmless MyHuis from claims, damages, losses, and expenses arising out of your use of the Service, your violation of these Terms, or your interactions with third parties, to the extent permitted by law.
10. Arbitration and Class Action Waiver
Governing Arbitration Law
These Terms affect interstate commerce and are governed by the Federal Arbitration Act (“FAA”).
Agreement to Arbitrate
Except where prohibited by law, any dispute arising out of or relating to these Terms or the Service shall be resolved by binding, confidential arbitration administered by the American Arbitration Association (AAA) on an individual basis.
No Class or Representative Actions
Arbitration shall proceed only on an individual basis. Class, collective, and representative actions are waived.
Mass Arbitration / Batching Clause
To the extent permitted by applicable law, the arbitration administrator may consolidate, batch, or apply bellwether procedures to the resolution of similar claims brought by or on behalf of multiple users that raise substantially similar factual or legal issues, provided such procedures do not result in a class or representative arbitration.
Mass Arbitration Sequencing & Bellwether Procedures
To the extent permitted by applicable law, the arbitration administrator may group, sequence, or batch the resolution of substantially similar claims and apply bellwether or test-case procedures to efficiently resolve common factual or legal issues. The outcomes of any bellwether proceedings may be used to inform the resolution of remaining claims, provided that each claim is ultimately resolved on an individual basis and not as a class or representative action.
Nothing in this section limits the arbitrator’s authority to ensure fairness in accordance with applicable AAA rules.
11. Governing Law and Venue
Except where preempted by the FAA, these Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
